SUBJECT:Resolution 2019-274 of the City Council of the City of Fairfield Approving an Agreement between Fairfield and Suisun Transit (FAST) and the Solano Transportation Authority (STA) for Operation of SolanoExpress Blue and Green Express Lines

RECOMMENDED ACTION 

Adopt resolution.

STATEMENT OF ISSUE 
The City of Fairfield and the Solano Transportation Authority (STA) previously entered into an agreement for the operation of intercity transit routes in 2009. That agreement has since expired. The proposed resolution would authorize the City Manager to enter into a new agreement between the City and STA for operation of the SolanoExpress Blue and Green Express Lines.
DISCUSSION

The City, which operates Fairfield and Suisun Transit (FAST), currently operates the SolanoExpress Blue and Green Express Lines. These two routes provide intercity and inter-regional bus services that connect the communities of Solano County with UC Davis, Sacramento, and BART stations at El Cerrito del Norte and Pleasant Hill. Solano County Transit (SolTrans) is the other Solano County operator of intercity services. Since 2018, FAST and SolTrans have been working to better coordinate intercity operations to ensure a consistent, streamlined service for Solano County residents (e.g., paper and most Clipper passes can now be used on any SolanoExpress route).

Since 2006, the Intercity Transit Funding Agreement (ITFA) has been the controlling document for the shared funding of intercity routes. The ITFA was most recently updated in 2012. The parties to the ITFA include the STA, the County of Solano, SolTrans, and the Cities of Dixon, Fairfield, Suisun City, and Vacaville. The ITFA outlines the cost sharing formula that is adjusted annually based upon ridership and population. The parties meet at least annually as the Intercity Transit Funding Working Group (ITFWG).

The City of Fairfield both contributes and receives funding as an operator through the ITFA. In Fiscal Year 2019/20, FAST will be receiving $3,590,987 in Transportation Development Act, State Transit Assistance, and Regional Measure 2 funding to operate the Blue and Green Express Lines.

The ITFA identifies STA as the party to coordinate intercity transit services and also designates the ITFWG to monitor the work performed by STA. STA requested the proposed Operating Agreement with FAST to clarify roles and responsibilities related to the operations of the Blue and Green Express Lines. STA entered into a similar agreement with SolTrans earlier this year.

The following outlines the major agreement points:

 

  • STA contracts with FAST to operate the Blue and Green Express Lines.
  • The agreement term runs for two years from July 1, 2019 through June 30, 2021 with the option to extend the agreement for one additional year, until June 30, 2022.
  • Fares collected and advertising revenue received will be retained by the City.
  • Funding will be reconciled, revised, and approved annually by the ITFWG, the Intercity Transit Consortium, and the STA Board.
  • Either party may terminate the Agreement, without cause, upon a hundred eighty (180) calendar days written notice to the other party.
  • Upon termination of the Agreement, City agrees to transfer title to four (4) buses purchased with STA funds.

FINANCIAL IMPACT
There are no immediate financial impacts associated with approval of the Operating Agreement, but the City would have no guarantee they would continue to operate the two routes after the initial two-year period ending June 30, 2021. Additionally, upon termination of the Agreement, the City may need to replace the four (4) buses transferred to STA, in order to continue operating the service at current levels.

ALTERNATIVE ACTION 
The City Council could choose to not approve the proposed Operating Agreement or could request changes to the agreement. However, the STA is currently withholding $500,000 in one time State Transit Assistance Funding from FAST until an agreement with FAST is executed, so any delay in entering into an agreement will delay the City’s receipt of those funds.
