SUBJECT:Resolution 2019-272 of the City Council of the City of Fairfield Authorizing Execution of the Improvement Agreement for the Clay Bank and Gulf Traffic Signal Improvements

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
On February 20, 2019, City Council approved the first amendment to the second amended and restated development agreement for the Villages at Fairfield. The agreement approved approximately 1,800 single-family residential homes and set requirements for the development. The development requires the construction of a new four-way traffic signal at the intersection of Clay Bank Road and Gulf Drive. The recommended action authorizes execution of the Improvement Agreement for the traffic signal improvements.
DISCUSSION
The first amendment to the second amended and restated development agreement with Rancho Tolenas for the Villages at Fairfield requires the developer to construct specific infrastructure improvements. The agreement also includes the timing for when the improvements are required to be constructed and establishes the amount of reimbursements and/or development impact fee credits earned for each infrastructure project.

Rancho Tolenas has constructed the Manuel Campos Parkway extension and is currently constructing other improvements along Clay Bank Road. The proposed agreement will approve the installation of a new four-way traffic signal facilitating vehicle movements along Clay Bank Road at Gulf Drive. Once constructed the new traffic signal will allow all modes of transportation safe access into the Villages at Fairfield subdivisions. In conjunction with the construction of the new traffic signal, the developer will make drainage and roadway improvements at this location.

The developer has provided all of the necessary bonds and insurance, and has paid the fees required to enter into this Improvement Agreement. The developer anticipates starting construction immediately after approval of this Agreement and expects the project will be completed within one year. In conformance with the development agreement, the Improvement Agreement documents the amount of development impact fee credits earned by the construction of these infrastructure projects.

FINANCIAL IMPACT
The developer will receive AB 1600 Traffic Impact Fee Credits in the amount of $102,375 for the traffic signal improvements. There is no cost to the City in constructing the public improvements covered in the Improvement Agreement. Once completed and accepted by the City Council, the public improvements will obligate the City to maintain these improvements including: the traffic signals, storm drain facilities, and roadway striping.

The developer has met the necessary conditions and has provided the proper documents for the Improvement Agreement. However, if the City Council has any questions regarding the public improvement construction, approval may be postponed until the questions are addressed.
