SUBJECT:Resolution 2019-270 of the City Council of the City of Fairfield Declaring its Intention to Vacate a Portion of Ramsey Road and Setting a Public Hearing Thereon

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
The Development Agreement between the City and Pacific Flyway Fund (Developer) requires the City to vacate a portion of Ramsey Road, south of the Gold Hill Road/I-680 Interchange. The recommended action initiates the proceedings and sets a public hearing for December 17, 2019.
DISCUSSION
On December 5, 2018, the City and the Developer entered into a Development Agreement (Agreement) to develop approximately 560 acres for the Pacific Flyway Center (Center) as an open space land preserve with an interpretive nature center. The Agreement requires the City to initiate proceedings to vacate the portion of Ramsey Road lying south of the intersection of Gold Hill Road and Ramsey Road. This street section is no longer necessary for present or prospective use as a public street, but will instead be utilized as a private driveway for the Center.

Pursuant to California Streets and Highways Code Section 8320 et seq., the City of Fairfield may initiate proceedings to vacate excess right of way within the City of Fairfield. The process requires the City Council hold a public hearing. Staff recommends that the Council adopt this proposed resolution of intention to vacate a portion of Ramsey Road and set a public hearing for December 17, 2019.

At the public hearing, the City Council will receive evidence offered by interested persons. After considering this evidence, the Council may find that the street is unnecessary for present or prospective use and adopt a resolution of vacation.

FINANCIAL IMPACT
There is no fiscal impact. The Developer shall assume full responsibility for the improvement and maintenance of vacated Ramsey Road.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION 
The Planning Commission will review this proposed road vacation for conformity with the General Plan at its December 11, 2019 meeting. This item will be published in the Fairfield Daily Republic and the street will be posted, as required by law.
