SUBJECT:Resolution HA2019-11 of the Fairfield Housing Authority Approving Conveyance of a Drainage Easement Within 1700 Santa Monica Way

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
A request has been made that the Fairfield Housing Authority (FHA) grant a drainage easement to the City of Fairfield on land located at 1700 Santa Monica Way. An easement for this purpose in this location is necessary, and adoption of this resolution would authorize this grant of easement.
DISCUSSION
FHA is the current owner of the property (APNs: 0037-053-560, 0037-340-010, 0037-053-700 & 0037-340-190). MidPen Housing Corp. (MidPen) is in discussion with City staff regarding the acquisition of this 3.57-acre site. Staff anticipates finalizing a development agreement in the coming months and transferring the land to MidPen soon after. Conveyance of this new drainage easement will facilitate development of the planned 71 affordable housing units and 1 management unit.

ENVIRONMENTAL REVIEW
Staff has reviewed the proposed action and determined that it is not a project subject to the California Environmental Quality Act (CEQA) because, pursuant to Sections 15060(c)(2) and 15060(c)(3), it does not have the potential for resulting in either a direct or reasonably foreseeable indirect physical change in the environment. In the alternative, if the action is considered a project, it is exempt pursuant to Section 15061(b)(3) because it can be seen with certainty that there is no possibility it may have a significant effect on the environment.
