| | | | | | | | STATEMENT OF ISSUE | Proposed amendments to Chapter 8 of the Fairfield City Code adopt the California Fire Code. They will update the existing City fire codes to provide the City of Fairfield with the latest available fire regulations, as mandated by the State Health and Safety Code. To adopt the proposed amendments, the City must first set a public hearing date regarding the subject ordinance and provide proper notice of the public hearing date. |

| | | | | | | | DISCUSSION | In California, fire codes are adopted on a three-year cycle. The adoption of the California Building Standards Code (CBSC) incorporates the latest standards for fire safety.
The CBSC becomes effective at the local level 180 days after State adoption (January 1, 2020). The State Health and Safety Code allows local jurisdictions to adopt amendments to the State Code.
When a city makes local amendments (other than administrative changes) to the State Building Standards, it must make express findings that the amendments are reasonably necessary because of local climatic, geological or topographical conditions. The Health and Safety Code requires the City to submit those findings to the State Building Standards Commission.
To adopt local amendments, pursuant to California Government Code Section 50022.3, the City must schedule a public hearing “[a]fter the first reading of the title of the adopting ordinance and of the title of the code to be adopted thereby, and of the title of the secondary codes therein adopted by reference.” Notice of the public hearing must be published pursuant to California Government Code Section 6006, which requires two publications providing notice of the public hearing, with the “period of notice commenc[ing] upon the first day of publication and terminat[ing] at the end of the fourteenth day, including therein the first day.”
