SUBJECT:Resolution 2021-236 of the City Council of the City of Fairfield Approving the Final Map and Authorizing Execution of the Subdivision Improvement Agreement for The Enclave at Red Top - Unit 2 Subdivision

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
Per Section 25.165 of the City of Fairfield municipal code, prior to City Council approval of a final map, the developer is required to enter into an agreement with the City to construct the proposed improvements. The recommended action approves the final map and authorizes execution of the subdivision improvement agreement (“Agreement”) for The Enclave at Red Top Unit 2 subdivision (Enclave Unit 2).
DISCUSSION
Albert D. Seeno Construction Company (“developer”) is proposing to build the second phase of the Enclave at Red Top Subdivision, located on the north side of Red Top Road, between Watt Drive and the Interstate 80 eastbound on-and-off ramps. The proposed development will provide roadway access and utility services to an additional 63 low-density, single-family residential lots by extending existing infrastructure improvements, previously authorized by council, constructed with the first phase of the subdivision. Approval of the final map and execution of the Agreement will obligate the developer to construct all public and private improvements, including streets, underground utilities, streetlights, and landscaping, to serve the future residents of the proposed subdivision.

Pursuant to the development agreement, the execution of the Agreement requires the developer to construct two important improvements to serve development along Red Top Road, specifically 1) improvements widening Red Top Road from Havenhill Road to the Interstate 80 eastbound on-and-off ramps, and 2) construction of a potable water pump station. The developer is required to begin construction of these improvements prior to the issuance of 1) the 90th certificate of occupancy, and 2) the 70th building permit within Zone 2, respectively. Plans and improvement agreements for construction of the widening improvements and the Zone II pump station will be brought to council for consideration at a later date.

The proposed development is less than a mile from Rodriguez High School and future residents of this subdivision will be able to walk to the high school along Red Top Road and Watt Drive. A signalized intersection was installed at the Havenhill and Red Top Road intersection to further facilitate safer travel. Furthermore, sidewalk on the north side of Red Top Road, between Havenhill Road and Watt Drive, is to be installed with development of the Cordelia Industrial Buildings project, on the northwest corner of Red Top Road and Watt Drive, which is under review by City staff. These improvements will provide a safer path of travel from the subdivision to the existing signalized intersection at Red Top Road and Watt Drive.

The developer has provided all the necessary bonds and insurance, and paid the fees, required to enter into this Agreement.

As part of the development obligations, the developer will be providing dust control by frequently applying water to the site throughout construction, which is a typical mitigation. Additionally, hours of construction will be limited to 7 a.m. – 5 p.m. to minimize construction impacts. The developer will also provide public outreach to notify residents and nearby business owners of anticipated construction impacts.

FINANCIAL IMPACT
There is no cost to the City in constructing the public improvements contemplated under the Agreements. Acceptance of the public improvements by council will obligate the City to maintain the public improvements, including Lavender Street, Valerian Drive, and water, sewer and storm utility infrastructure, sidewalks, streetlights, and appurtenant facilities. This development is included within the boundary for Community Facilities District (CFD) #2012-2, which will provide funding for public safety services, operation and maintenance of open space areas, and operation of neighborhood parks.

This development is also included within the boundary for Landscape and Lighting Maintenance District (LLMD) #16 providing funding for maintenance of public landscape and lighting within the Cordelia area. All landscaping in this subdivision will be maintained by various fronting property owners.

The City’s portion of the property tax collected through the County is expected to be approximately $68,000 assuming an assessed per home value of $800,000. Water and sewer rates, sewer service fees, storm drainage maintenance fees, gas tax, and general fund will be used to offset costs of services provided by the City.

ALTERNATIVE ACTION 
Sections 66458 and 66462 of the Subdivision Map Act require that the council approve the Agreement if conditions of the tentative map have been met. The developer has met the necessary conditions and has provided the proper documents for the Agreement. However, if the council has any questions regarding the layout of the subdivision or public improvement construction, approval can be postponed until the questions are addressed.
