SUBJECT:Resolution 2021-235 of the City Council of the City of Fairfield Authorizing Execution of the Improvement Agreement for the Canon Station Planning Area 4 – Phase 2 Backbone

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
One Lake Holding, LLC (“developer”) previously constructed infrastructure to provide utility service and roadway access improvements to the southwesterly half of the Canon Station Planning Area 4 development (“development”). The developer is ready to begin construction of the next phase of infrastructure, referred to as Phase 2 Backbone (Phase 2). The recommended action authorizes execution of the improvement agreement for the Phase 2 Backbone improvements (“Agreement”), extending the previously constructed roadway improvements, to serve the future residential homes on the northeasterly area of the planned development.
DISCUSSION
City Council previously authorized construction of the first phase of backbone improvements by adoption of council Resolution No. 2018-170 (“Phase 1”). Phase 1 roadways connect to Vanden Road, providing access to all modes of transportation to the first phase of the Canon Station development. Upon execution of the Agreement, the developer will construct Phase 2 improvements, which includes Lake Club Drive, a primary access to several subdivisions within the development and a critical arterial roadway connecting Planning Area 4 to the future Planning Areas 1, 2, and 5 of the Train Station Specific Plan (TSSP). Phase 2 will also construct a portion of the Lake Trail roadway, connecting Lake Club Drive to Neighborhood 8, previously authorized by council, providing a secondary point of access to the subdivision. The Lake Trail roadway provides vehicle, bicycle, and pedestrian access to the north side of the existing lake, including a future parking lot. Maintenance vehicles will also be able to use Lake Trail to quickly access the existing lake pump station, for any crucial tasks necessary to maintain the lake water quality and volume.

The Phase 2 improvements also include landscaping along these roadways, specifically a corridor of maple trees along Lake Club Drive, which will further immerse future residents in the resort aesthetic of the Planning Area 4 community and provide additional separation between pedestrians and vehicles. City staff worked with the developer to select from a plant palette that satisfies the requirements of the TSSP, providing a quality aesthetic, yet sustainable, landscape along the streets. In addition, the future Homeowner’s Association for the development will provide recurring maintenance for the landscape.

Lastly, Phase 2 also includes extension of water, sewer, and storm utilities to provide utility service to the future subdivisions within Planning Area 4, in addition to extending the primary water main serving the future Planning Area 5.

The Phase 2 improvements will have no traffic impacts as the improvements contemplated are outside of any active roadways. The developer will minimize disturbances to nearby residents by working within the allowed construction hours between 7am-5pm and performing public outreach to notify residents of any anticipated construction impacts.

The developer has provided all of the necessary bonds and insurance, and paid the fees required to enter into this Agreement.

FINANCIAL IMPACT
There is no cost to the City in constructing the public improvements contemplated under the Agreement. Acceptance of the public improvements by council will obligate the City to maintain the public improvements, including Lake Club Drive, Lake Trail, and public water, sewer, and storm utilities. Maintenance costs shall be funded by the formed TSSP Community Facilities District (CFD) #2018-1 and One Lake Infrastructure CFD #2019-1.

Pursuant to the development agreement with the developer, with council authorization for the City to enter into and execute this Agreement, the developer shall be assigned to design New Canon Road, from the Putah South Canal to North Gate and New McCrory Road, consistent with the requirements and orientation identified in the TSSP and Northeast Fee program. In exchange for this design, the developer shall earn, upon providing the City the required documentation for developer’s design costs, fee credits for those segments of New Canon Road and McCrory Road included within the Northeast fee program, including Segments 38-40, 42, and 44-45. Fees are applicable to Northeast Transportation, Northeast Linear Park, and AB1600 Traffic Impact Fees, as described in the development agreement and more particularly described in the Agreement.

ALTERNATIVE ACTION 
The developer has met the necessary conditions and has provided the proper documents for the Agreement. However, if the council has any questions regarding the public improvement construction, approval can be postponed until the questions are addressed.
