RECOMMENDED ACTION 
Hold public hearing and adopt resolutions.
STATEMENT OF ISSUE 
The adoption of the attached resolutions will complete the process for the annexation of Green Valley Corporate Park Building A Parking into the Landscape and Lighting Maintenance District No. 13 (North Cordelia) (the “LLMD No. 13”). LLMD No. 13 was established as an annexable district to provide funding for the ongoing maintenance of the landscaping, lighting, and appurtenant facilities within the district.
DISCUSSION
The City Council established LLMD No. 13 in 1990 with the adoption of Resolution No. 1990-195. The special assessments collected with the property taxes are utilized by the City to maintain the various landscaping and lighting improvements within the district.

The property proposed for annexation is owned by Fairfield Industrial Holdings I, LLC and includes 1.94 acres of land located east of Business Center Drive, west of Neitzel Road and northwest of Interstate 80 within the boundaries of assessor’s parcel number 0148-540-380, as depicted on Exhibit A. The property will be developed into a parking lot. The conditions of development for Green Valley Corporate Park Building A requires that the property be annexed to the LLMD No. 13 to provide for its proportional share of the ongoing maintenance of the landscaping and lighting improvements.

In conformance with the provisions of Proposition 218, the City must establish whether improvements are of a general benefit or of a special benefit (i.e. being a particular and distinct benefit over and above general benefits conferred on real property in the annexation territory or to the public at large). Assessments cannot be levied to pay for general benefit. The Engineer’s Report (Attachment 4) provides an analysis of the special benefits the district will receive as a result of this development.

The estimated maximum annual assessment for the Green Valley Corporate Park Building A is $287.98 per acre, for a total of approximately $558.68 in fiscal year 2021-2022. It has been determined that the improvements associated with this annexation confers no general benefit and therefore no General Fund contribution shall be made to the LLMD No. 13 (Fund 085).

On July 6, 2021, Council adopted Resolutions 2021-150 through 2021-152 initiating proceedings for annexation of the territory, providing preliminary approval of the engineer’s report, and declaring its intention to annex the territory to LLMD No. 13. Adopting the attached resolutions is the final step in the annexation process. Since the conditions of approval of the Green Valley Corporate Park Building A require it to annex into the Maintenance District and all parcel is owned by Fairfield Industrial Holdings I, LLC, a majority protest of the annexation is not anticipated.

FINANCIAL IMPACT
The anticipated annual revenue to be received by LLMD No. 13 (Fund 085) for this annexation is estimated to be $558.68, which is based on the fiscal year 2021-2022 maximum annual assessment of $287.98 per acre. No General Fund contribution will be made for any improvements associated with this annexation. The LLMD No. 13 maximum assessment rates include an automatic annual consumer price index (CPI) adjustment. The process for the annexation is funded by the developer and no General Fund monies are used for this effort.

ALTERNATIVE ACTION 
If the council has any questions concerning the required annexation of this development, this item may be rescheduled until the next council meeting to allow staff to provide the necessary backup. However, if the annexation is not approved, the conditions of approval for this development would not be fulfilled and the development process would cease.
