SUBJECT:Resolution 2021-213 of the City Council of the City of Fairfield Ordering the Summary Vacation of a Portion of Air Base Parkway, Declaring Said Vacated Land to Be Exempt Surplus Land, and Authorizing Conveyance of Said Vacated Land

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
Century Communities of California, LLC (“developer”) requests the City vacate a portion of Air Base Parkway right-of-way, directly abutting their development parcel. The recommended action conveys this vacated area and allows the developer to construct and maintain the future soundwall along their property line, which currently bisects an existing wetland and restricts construction of the soundwall.
DISCUSSION
On June 15, 2021, City Council approved the final subdivision map for the Monte Verde Subdivision (“development”). The proposed development is located on vacant land on the southeast corner of the Dobe Lane and Peabody Road intersection, north and adjacent to Air Base Parkway. The development’s conditions of approval require the construction of a minimum 10-foot high soundwall between Air Base Parkway and the subdivision.

Subsequent to council approval of the development, the developer’s biologist conducted a field survey to delineate the extents of an existing wetland adjacent to Air Base Parkway. Through their field reconnaissance, it was determined that the wetland is located on the right-of-way line, restricting construction of the required soundwall. Due to the location of the wetland, it is necessary to modify the previously approved soundwall alignment to facilitate construction, prevent construction delays, and minimize impact to environmentally sensitive habitat within the wetland area. The new, re-aligned soundwall location requires the City to summarily vacate an area, that varies in width from 0-10 feet along Air Base Parkway, and convey it to developer. Upon execution and recordation of the grant deed conveying that portion of Air Base Parkway to the developer, that portion area of land, including the existing wetland, will be owned and maintained by the developer.

This proposed vacation will have no impact on present travel on Air Base Parkway. The developer has obtained the required federal and state resource agency permits and project approvals to commence work on the soundwall.

All costs and fees associated with this vacation will be the responsibility of the developer.
