Resolution 2021-187 of the City Council of the City of Fairfield Authorizing Execution of the Landscape Improvement Agreement for the Canon Station Planning Area 4 – Neighborhood 8 Subdivision; and

Resolution 2021-188 of the City Council of the City of Fairfield Ordering the Summary Vacation of Easements Adjacent to Canon Station Planning Area 4 – Neighborhood 8 Subdivision

STATEMENT OF ISSUE 
Per Section 25.165 of the City of Fairfield municipal code, prior to City Council approval of a final map, the developer is required to enter into an agreement with the City to construct the proposed improvements. The recommended action approves the final map and authorizes execution of the subdivision improvement agreement and the landscape improvement agreement (“Agreements”) for the Canon Station Planning Area 4 – Neighborhood 8 subdivision (N8).

In order to extend access from Waterside Drive to Lake Trail, staff recommends the vacation of existing easements for public access and public service purposes. The developer can then execute a grant deed to the City for street right of way purposes over a strip of land adjacent to the N8 map and between the existing Lake Trail street right-of-way.
DISCUSSION
As part of the Lake District Specific Plan, located east of Peabody Road and northwest of Vanden Road, within the greater Train Station Specific Plan, One Lake Holding, LLC (“developer”) is proposing to construct the Canon Station Planning Area 4 – Neighborhood 8 subdivision (“subdivision”). The subdivision consists of 56 low-density, single-family residential homes that directly abuts the Lake Park, providing direct access to future park amenities including leisurely walks around the 10-acre lake. Approval of the final map and execution of the Agreements will obligate the developer to construct all public and private improvements, including streets, underground utilities, streetlights, and landscaping, to serve the future residents of the proposed subdivision. The required bio-retention basins constructed within the neighborhood will be privately owned and maintained by the Homeowner’s Association (“HOA”).

The subdivision is oriented, and site planned, to provide quick and immediate access to the Lake Park and the Lake Park amenities. The roadway layout is deliberately aligned parallel to the Lake Park, allowing residents of this subdivision, and the future high-density developments, to quickly access the park at three primary entrances. Park visitors will be welcomed by a breathtaking, unobstructed view of the Lake Park, and the future Lake Trail Park recreational center, as vehicles enter from Vanden Road/Jepson Parkway.

Open-view fencing will be installed along the property lines of lots abutting the Lake Park, allowing future residents to enjoy the aesthetic and community of the Lake Park from the comfort and security of their backyard.

The developer has provided all the necessary bonds and insurance, and paid the fees, required to enter into this Agreement.

As part of the development obligations, the developer will be providing dust control by frequently applying water to the site throughout construction, which is a typical mitigation. Additionally, hours of construction will be limited to 7 a.m. – 5 p.m. to minimize construction impacts. The developer will also provide public outreach to notify residents and nearby business owners of anticipated construction impacts.

FINANCIAL IMPACT
There is no cost to the City in constructing the public improvements contemplated under the Agreements. Acceptance of the public improvements by council will obligate the City to maintain the public improvements, including Waterside Drive, Lake Vista, and water, sewer and storm utility infrastructure. Sidewalks, streetlights, and appurtenant facilities will be maintained by the HOA with a portion of maintenance costs being funded by the formed Community Facilities District #2018-1 (“CFD #2018-1”). This development is included within the boundary of CFD #2018-1, which will provide funding for public safety services, lighting & landscape maintenance, and the operation and maintenance of open space areas, parks, and future cemetery.

The City’s portion of the property tax collected through the County is expected to be approximately $68,000 assuming an assessed per home value of $800,000. Water and sewer rates, sewer service fees, storm drainage maintenance fees, gas tax, and general fund will be used to offset costs of services provided by the City. All landscaping will be maintained by either the Homeowner’s Association, various fronting property owners, or through the CFD funding.

ALTERNATIVE ACTION 
Sections 66458 and 66462 of the Subdivision Map Act require that the council approve the Agreement if conditions of the tentative map have been met. The developer has met the necessary conditions and has provided the proper documents for the Agreement. However, if the council has any questions regarding the layout of the subdivision or public improvement construction, approval can be postponed until the questions are addressed.
