SUBJECT:Resolution 2021-135 of the City Council of the City of Fairfield Declaring Its Intention to Vacate a Portion of Red Top Road and Setting a Public Hearing Thereon

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
The City is interested in leasing a City-owned parcel located on Red Top Road north of Interstate 80. However, the current configuration of the parcel is narrow and vacating a portion of Red Top Road right-of-way would allow for a more developable project. Staff recommends the initial proceedings to vacate excess right-of-way by adopting the proposed resolution, which states the City’s intent to vacate a portion of Red Top Road and sets a public hearing for July 6, 2021.
DISCUSSION
The City owns fee title to a narrow parcel located between Red Top Road and the Caltrans right of way for Interstate 80, assessor’s parcel number (APN) 180-010-090. The parcel is vacant. Although the parcel is designated for highway and regional commercial land uses, its current size and shape make it unsuitable for this type of development. In order to improve the parcel’s usability, City staff propose that the City vacate the right-of-way for an adjacent 1,169 square-foot section of Red Top Road, for which the City owns the underlying fee. Once the vacation is complete the narrow parcel and the section of former right-of way can be merged into a single parcel. Both the area proposed to be vacated and the adjacent narrow parcel are shown on the plat map included as Exhibit B to the proposed resolution.

Staff has determined the remaining right-of-way for Red Top Road is adequate to ensure that the proposed vacation will not adversely impact vehicular use of the road.

Pursuant to California Streets and Highways Code Section 8320 et seq., the City may initiate proceedings to vacate excess right of way within the City of Fairfield. The right-of-way vacation is a multi-step process. On May 26, 2021, the Planning Commission reviewed the proposed vacation for conformity with the General Plan and issued its recommendation. The City Council next provides direction by adopting a resolution declaring its intent to vacate the right-of-way and scheduling a public hearing on the matter. Pursuant to Sections 8322 and 8323 of the Streets and Highways Code, the City will publish notice of the proposed vacation in the newspaper and post notices at the site. Finally, once the council has conducted the public hearing, and if the council adopts a resolution confirming the vacation, the vacation will be finalized by recording the necessary documents with the county recorder’s office. The lot merger would be completed following the vacation.

FINANCIAL IMPACT
There is no fiscal impact. The developer shall assume full responsibility for the costs associated with vacating a portion of Red Top Road.
PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION 
The Planning Commission reviewed and approved the proposed vacation for conformity with the General Plan at its meeting on May 26, 2021. Notice of the public hearing on the proposed vacation will be published in the Fairfield Daily Republic and the street will be posted.
