SUBJECT:Resolution 2021-132 of the City Council of the City of Fairfield Authorizing the City Manager to Execute a Right of Entry and License Agreement for Accessing Property Owned by the City of Fairfield for A Temporary Water Line at Paradise Valley Reservoir

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
The City of Vacaville has requested temporary access to a City-owned parcel located at the Paradise Valley Reservoir, in order to convey water from the Solano Irrigation District (SID). The water conveyance will provide drinking water for grazing cattle on the adjacent Vacaville property. The proposed right-of-entry and license agreement authorizes access to City property for a two-year term to facilitate a temporary water line.
DISCUSSION
Vacaville owns property used for cattle grazing adjacent to the City and have lost the source of water necessary to maintain the cattle well-being. The nearest source of water is an SID pipeline running along the adjacent property owned by the City known as Paradise Valley Reservoir. Vacaville has requested for a two-year agreement to install and maintain a temporary waterline, one inch in diameter and approximately 230 feet long, on City property.

A right-of-entry and license agreement is necessary to allow COV to enter the Paradise Valley Reservoir property and install a temporary water line. The attached documents have been drafted to satisfy the requirements agreed upon between the City and Vacaville to ensure completion of the work without interruption to the reservoir operations at Paradise Valley.

FINANCIAL IMPACT
Vacaville has agreed upon a nominal amount of $1,000 to access the land. Funding for this agreement will be deposited to the General Fund (Fund 011, division and responsibility code 99000).
