SUBJECT:Resolution 2021-65 of the City Council of the City of Fairfield Authorizing Execution of the Improvement Agreement for the Canon Station Planning Area 4 – Vanden Road Landscape

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
City had previously constructed roadway improvements widening Vanden Road, east of Peabody Road and along the new Planning Area 4 (Canon Station) development. As part of the Canon Station Development Agreement (“DA”), One Lake LLC (developer) was assigned by the City to install landscape improvements within and along the widened portion of Vanden Road. The recommended action authorizes execution of the Improvement Agreement (“Agreement”) for installing the required landscape.
DISCUSSION
In 2011, the City adopted the Fairfield Train Station Specific Plan, which identifies a plaza themed community gateway at the Peabody and Vanden Road intersection. The community gateway will include aesthetic improvements highlighting entry into both the Fairfield-Vacaville Hannigan Train Station and the City’s Northeast area, including stamped concrete, a seat wall, and an iconic monument sign. The developer will be constructing these amenities on the southeast corner of the intersection, fronting the train station, with improvements to the other corners occurring at a later date.

In addition, the developer will be installing unique streetscape improvements, per the adopted Train Station Specific Plan, within and along the currently widened portions of Vanden Road, which extends east from Peabody Road to approximately 1,500 linear feet south of Canon Road. The streetscape will include a lush corridor of trees, both within the road median and the landscape parkways, guiding vehicles towards the northeast, and opening-up to a view of the City’s open space as vehicles travel along the existing railroad. Small boulders, excavated from the Canon Station development, will also be intermixed with proposed shrubs and plant groundcovers along Vanden Road, providing a sense of familiarity and anticipation. Future residents will also be able to enjoy the landscape, as they travel from neighborhoods in the northeast towards the Fairfield-Vacaville Train Station.

The developer will minimize traffic impacts by working within the City to restrict hours of construction between 7am-5pm, and performing public outreach to notify residents of anticipated construction impacts.

The developer has provided all of the necessary bonds and insurance, and paid the fees required to enter into this Agreement. With Council authorization for the City to enter into and execute this Agreement, the developer shall accrue a total of $3,574,329.00 in fee credits applicable towards, and to be used for, Northeast Transportation, Northeast Linear Park, Northeast Capital Improvements, and AB1600 Traffic Impact Fees, as described in the DA and more particularly described in the Agreement.

FINANCIAL IMPACT
There is no cost to the City in constructing the public improvements contemplated under the Agreement. Acceptance of the public improvements by City Council will obligate the City to maintain the public improvements, including the landscape, irrigation, and related appurtenances within and along Vanden Road. Maintenance costs shall be funded by the formed Train Station Specific Plan Community Facilities District (CFD #2018-1).

ALTERNATIVE ACTION 
The developer has met the necessary conditions and has provided the proper documents for the Agreement. However, if the City Council has any questions regarding the public improvement construction, approval can be postponed until the questions are addressed.
