SUBJECT:Resolution 2021-62 of the City Council of the City of Fairfield Approving the First Amendment to Lease Agreement between the City of Fairfield and T-Mobile West, LLC for the Cellular Site Located at 1000 Cement Hill Road, Fairfield, More Commonly Known as Laurel Creek Park (APN 0168-130-180)

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
The City of Fairfield (the “City”) and T-Mobile West, LLC (“T-Mobile”), would like to enter into the proposed First Amendment to Lease Agreement (“Amendment”) for the increase in lease area and installation of a gas-powered generator at T-Mobile’s existing cellular site located at 1000 Cement Hill Road more commonly known as Laurel Creek Park (the “Property”).
DISCUSSION
The City and T-Mobile entered into a Lease Agreement on January 6, 2004 allowing T-Mobile to construct and maintain a cellular site on the Property.

Due to increasing power outages and new state requirements, T-Mobile needs to expand their lease area to allow for the installation of a gas-powered generator at their site. The City agreed to the expansion of lease area and generator installation with an increase in the monthly rent amount of $400.00 and the requirement that T-Mobile receive all necessary local, state, and governmental approval prior to the installation of the generator.

The Amendment allows for T-Mobile to build a second enclosure, across from their existing cellular site, that will house the generator and supporting equipment. T-Mobile has agreed to install an electrical outlet on the exterior wall of the second enclosure to be used by the City and the baseball club that currently utilizes the field adjacent to the cellular site. There will be no current or future costs to the City or the baseball club for the installation or use of the electrical outlet.

The attached Resolution approves the Amendment and authorizes the City Manager to execute all documents necessary for the approval of the Amendment.

FINANCIAL IMPACT
Upon execution of the Amendment, T-Mobile’s monthly rent will increase by $400.00 per month from $2,458.97 to $2,858.97. The additional funds will be included with the then current monthly rent amount and continue to be deposited into the City’s General Fund Account Code 011-99-000-6505.

ALTERNATIVE ACTION 
The City Council can choose not to approve the transaction and terminate the Amendment with the parties.
