Resolution 2021-10 of Local Support Authorizing the Filing of an Application for Funding Assigned to the Metropolitan Transportation Commission and Committing Any Necessary Matching Funds and Stating the Assurance to Complete the Cadenasso Drive Pavement Reconstruction Project

STATEMENT OF ISSUE 
Approval of the two resolutions allows the Cadenasso Drive Pavement Reconstruction Project (Project) access to $1.394 million in federal grant funding. The first resolution authorizes an amendment to the Funding Exchange Agreement with the Solano Transportation Authority (STA). The second resolution is a requirement of the Metropolitan Transportation Commission (MTC) for the City to submit a Resolution of Local Support authorizing the filing of an application for funding, committing any necessary matching funds, and stating the assurance to complete the Project.
DISCUSSION
On October 19, 2018, the City executed a Funding Exchange Agreement (Agreement) with STA for $1,394,000 of federal Surface Transportation Program (STP) funds in the Transportation Improvement Program (TIP) to develop and construct transportation improvements within the Heart of Fairfield Plan area. The Agreement provides that the City will repay $1.254 million in local funds from the AB 1600 Traffic Impact Fee Fund or gas tax in exchange for the STP funds. In addition, the City is required to notify STA, in writing, whether the TIP funds will be expended by Fiscal Year 2021-22.

At the time of the Agreement execution, staff identified the use of federal funding on the West Texas Complete Street Project. It was envisioned that the $1.394 million in federal funding, combined with additional local revenue, would allow for the construction of a one-block stretch of the planned improvements to West Texas, or some other meaningful initial phase of improvements. The range of anticipated costs for a first-phase project was between $1.5 and $2.0 million. Through the design development and preliminary engineering phases of the West Texas Complete Street Project, the estimated cost to complete all the improvements as outlined in the Heart of Fairfield Specific Plan was updated to approximately $16 million. Based on this updated estimated cost, the plan to construct a meaningful first phase for $1.5 to $2.0 million is no longer practical or recommended. Therefore, staff is recommending that the $1.394 million in federal funding be shifted to a different project, Cadenasso Drive Pavement Reconstruction, while staff explores alternative funding opportunities for the West Texas Complete Street Project.

The First Amendment to the Agreement permits the City to utilize the funding for pavement maintenance work on Cadenasso Drive located in the Heart to Fairfield Specific Plan area and shifts the funding obligations from Fiscal Year 2021-22 to Fiscal Year 2022-23. It also provides a one-year extension to the Agreement timeline. The STA Board has approved the amendment, and the STA Executive Director has been authorized to sign the amendment once approved by the City.

Cadenasso is an arterial street that provides access to the Fairfield Transportation Center (FTC). The heavy bus traffic associated with the FTC has heavily impacted Cadenasso and it is in extremely poor condition. The City recently reconstructed portions of Beck Avenue leading to the FTC. Cadenasso is proposed to receive a similar reconstruction. The $1.394 million TIP funding will allow the City to advance the Cadenasso Drive pavement reconstruction improvements sooner than anticipated. The TIP grant is programmed for Fiscal Year 2022-23.

As a requirement to receive the TIP funding, staff will submit an application to MTC for Regional Discretionary Funding in the amount of $1.394 million. As part of the application, MTC requires the Fairfield City Council to adopt a resolution committing to allocate local funds for any required improvements that are not eligible for grant funding.

The resolution shall demonstrate:
• That the City of Fairfield understands that the Regional Discretionary Funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional Regional Discretionary Funding.
• That the Project will comply with the procedures, delivery milestones and funding deadlines specified in the Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised).
• Assurance of the City of Fairfield to complete the Project as described in the application, as included in MTC’s Federal Transportation Improvement Program (TIP).
• That the Project will comply with all project-specific requirements as set forth in the Program.

Public Works staff is confident that the City will meet all the conditions required by MTC.

FINANCIAL IMPACT
The proposed action will affirm the City’s intention to apply $1.394 million in grant funding under MTC’s TIP program, which receives source funding from the Federal Surface Transportation Program, to the Cadenasso Drive Pavement Reconstruction Project. Funding for the required local match of 11.47% ($159,892) will be budgeted in the upcoming Fiscal Year 2021-2022 budget in the Streets Capital Fund (Fund 252, Division and Responsibility Code 99499) utilizing gas tax or Measure P funds.

The Funding Exchange Agreement requires the City to repay STA with local funds from AB 1600 Traffic Impact Fee Funds or gas tax in the amount of $1,254,600 over two years.

ALTERNATIVE ACTION 
If the City Council has any questions, the recommended action may be delayed so that staff can provide the necessary backup. Staff does not recommend this because this will delay the delivery of the Project.
