SUBJECT:Resolution 2021-08 of the City Council of the City of Fairfield Authorizing Execution of the Improvement Agreement for Villages at Fairfield –Village II – Lot 3 Master Infrastructure Plans

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
Rancho Tolenas Corp. (developer) intends to satisfy construction obligations as part of the Development Agreement (“DA”) between City and developer. As part of the DA, developer is required to furnish the necessary bonds and documents to City and enter into an Improvement Agreement (“Agreement”) with the City for any public improvements. The recommended action authorizes execution of the Agreement for the Villages at Fairfield – Village II – Lot 3 Master Infrastructure improvements.
DISCUSSION
As part of the DA, executed between developer and the City, developer is required to install public improvements, including sewer force main improvements, as part of the Villages at Fairfield project. The subject improvements shall extend existing sewer infrastructure to the future lift station site, to be owned and maintained by the Fairfield-Suisun Sewer District (“FSSD”), located within Village II of the Villages at Fairfield development.

Upon completion of the future lift station, the proposed sewer improvements will receive outflow from the lift station providing new service to approximately 172 future single-family lots within Village II, future development along Strassberger Drive, continued service to the residents of the existing Bedford Falls subdivision, and the future Village III subdivisions. Upon activation of the future lift station, the existing sewer lift station serving this area, owned and maintained by City of Fairfield, shall be abandoned.

Lastly, as part of the Agreement, the developer shall extend the existing 12-inch water main, within High Line Drive, providing the necessary water infrastructure to service the 82 future single-family lots in Lot 3 of Village II.

The developer has provided all the necessary bonds and insurance, and paid the fees required to enter into this Agreement.

FINANCIAL IMPACT
There is no cost to the City in constructing the public improvements contemplated under the Agreement. Once completed and accepted by the City Council, the improvements will obligate the City to maintain the water infrastructure improvements. Maintenance costs for the public water infrastructure improvements will be from the Water Enterprise Fund. However, the proposed 12-inch sewer force main and lift station shall be owned and maintained by the FSSD.

ALTERNATIVE ACTION 
The developer has met the necessary conditions and has provided the proper documents for the agreement. However, if the City Council has any questions regarding the public improvement construction, approval can be postponed until the questions are addressed.
