SUBJECT:Resolution 2020-191 of the City Council of the City of Fairfield Summarily Vacating a Public Open Space Trail Easement Associated with the Paradise Valley Estates Expansion Project

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
The realignment of an existing 10-foot wide open space trail is a requirement of the Paradise Valley Estates Expansion Project (Project). As part of the realignment, a segment of the public open space trail easement must be abandoned. This resolution will vacate the portion of easement that is no longer in use.
DISCUSSION
The under-construction Project is located at 5700 Allegiance Court (APN:0167-080-220). The development of the Project requires a realignment of an existing 10-foot wide open space trail, which ultimately connects to Couples Court. Due to the realignment, a 634-foot long segment of the 10-foot wide open space trail easement is no longer needed and must be abandoned.

Staff requested the Project have a licensed land surveyor prepare legal descriptions and plats for both a new portion of trail, as well as for the requested City abandonment of the existing but no longer useable trail segment. A Grant Deed of Easement for the new open space trail easement has already been accepted by City staff. The California Streets and Highways Code authorizes the City Council to vacate public easements if they are not required for street and utility purposes. Staff agrees that the proposed vacation is appropriate.

FINANCIAL IMPACT
The proposed action will have no financial impact. Ongoing maintenance for the new trail will be covered in the Lighting and Landscape Maintenance District No. 11 - Paradise Valley North.
