SUBJECT:Resolution SA2020-02 of the Successor Agency to the Fairfield Redevelopment Agency Approving Execution of a Quitclaim Deed to Albert D. Seeno Construction Co. and H&S Energy, LLC

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
Albert D. Seeno Construction Co. (Seeno) is preparing to submit plans to the City of Fairfield for the residential development of an area formerly owned by the Fairfield Redevelopment Agency (FRA). The proposed resolution would authorize the Executive Director of the Successor Agency to the Fairfield Redevelopment Agency to execute a Quitclaim Deed to remove of record any interest of the FRA in and to the lands of Seeno and adjacent property owner H&S Energy, LLC.
DISCUSSION
In April 1991, the FRA brought an Action in Eminent Domain against Seeno for the H&S Energy, LLC property at 4720 Gold Hill Road, which was described in a legal description dated March 5, 1991. The court ordered in favor of FRA for prejudgment possession. FRA then conveyed this land to a buyer with a legal description dated April 16, 1991. The differences between the two descriptions have created an irregularity on legal title for both Seeno and H&S Energy, LLC, as adjacent property owners.

Adoption of the attached resolution authorizes the Executive Director to execute a quitclaim deed to both Seeno and H&S Energy, LLC, which will terminate of record any outstanding interest of the FRA in this land. Staff supports approval of this resolution.
