SUBJECT:Resolution 2020-183 of the City Council of the City of Fairfield Approving the Execution of Amendment No. 2 to the Amended and Restated Clipper Memorandum of Understanding

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
The Metropolitan Transportation Commission (MTC) has made minor modifications to the Restated Clipper Memorandum of Understanding (MOU). MTC formally adopted Amendment No. 2 to the MOU at its June 22, 2020, Clipper Executive Board Meeting. The City’s approval of Amendment No. 2 to the MOU is required for the City to continue participation in the Clipper Fare Program.
DISCUSSION
The Clipper program is a supplemental regional fare media program which allows passengers to freely utilize the services provided by all bay area transportation providers. On October 6, 2015, the City adopted Resolution No. 2015-226 approving the execution of the Amended and Restated Clipper Memorandum of Understanding with the MTC. On October 3, 2017, the City adopted Resolution No. 2017-224 approving the execution of Amendment No. 1 to the MOU.

Amendment No. 2 to the MOU will update the regional cost-sharing agreements between MTC and the transit operators, as well as incorporate other updates, including: inclusion of references to contracts needed to support the Next-Generation Clipper program, additional references and clarifications about “Affiliate Participant” agreements for transit operators based outside the Bay Area or for entities that are not transit operators, and general clean-up and clarifications.

FINANCIAL IMPACT
There is no impact to the General Fund as a result of this amendment. All operating and capital expenses for Fairfield and Suisun Transit are supported using specific State and Federal transportation revenue sources.
