| | | | | | | | STATEMENT OF ISSUE | The United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance (BJA) recently announced the availability of funds that will be awarded through the Fiscal Year 2020 Edward Byrne Memorial Justice Assistance Grant Program Local Solicitation (JAG). Due to grant disbursement requirements of the BJA, Solano County and the Cities of Vacaville, Fairfield, and Vallejo have signed a Memorandum of Understanding designating the City of Fairfield to serve as the fiscal agent for the grant and agree to a re-allocation and spending plan for the funds. The attached resolution authorizes the City of Fairfield to accept the grant funds and administer the program on behalf of Solano County. |

| | | | | | | | DISCUSSION | The goals of the programs funded by the JAG allocation for Solano County and the Cities are to support law enforcement programs and provide supplies and equipment to update and enhance the capabilities of local law enforcement such as body-worn cameras for police officers and interoperable radio equipment. Upon approval of the grant application, the City of Fairfield will accept and deposit the entire 2020 JAG award amount of $113,468 into an interest-bearing trust fund. At the end of each quarter, upon the receipt of quarterly report data from each agency and acceptance of the quarterly reports by the United States Department of Justice, the City of Fairfield will disburse the funds to each agency. The City of Fairfield will utilize the administrative funds from the JAG grant to cover the staff time costs associated with administering the funds, including reporting. Any interest earned from the JAG trust fund will be applied towards City of Fairfield program areas.
The period for the JAG grant is three years; however, each agency has agreed to expend their funds within two years. In the event that an agency does not expend their funds within two years, that agency will re-allocate additional administrative fees to the City of Fairfield to cover costs associated with administering the grant beyond two years.
Due to the disparate funding situation, the City of Fairfield, as the fiscal agent, must apply for the JAG grant funds with a single, joint application on behalf of all the eligible agencies within the County. Pursuant to United States Department of Justice regulations, only the fiscal agent’s legislative body, the Fairfield Council, is required to approve the application for funding on behalf of all the eligible agencies.

| | | | | | | | FINANCIAL IMPACT | The adoption of the resolution will enable the City of Fairfield Police Department to receive $34,532 in funding to implement programs as outlined in the final JAG application. Additionally, the City of Fairfield Police Department will receive $3,948 in funding for costs associated with administering the grant on behalf of Solano County and the Cities of Vacaville, Fairfield, and Vallejo. The grant is financed entirely by JAG funds and does not require a cash or in-kind match. In no case may these funds be commingled with any other funds, even other federal funds, nor may funds be used to supplant expenses for which the City of Fairfield has already appropriated funds. |

| | | | | | | | PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION | The JAG program requires the fiscal agent to accept public comment on the JAG application. In order to meet the requirement, a summary of the 2020 application was posted to the City of Fairfield website on July 15, 2020 for the public to comment on the application and spending plan. No public comments were received.
