SUBJECT:Resolution 2020-141 of the City Council of the City of Fairfield Authorizing the City Manager to Execute an Agreement for Acquisition of Public Service Easement between Northbay Health Care Group and the City of Fairfield for the construction of B Gale Wilson Boulevard Bus Stops Project

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
The City intends to construct a bus stop near 1200 B Gale Wilson Boulevard, which will provide improved transit access to and from Northbay Medical Center (Northbay). In order to construct the bus stop improvements, the City must acquire a public service easement (PSE) from Northbay Healthcare Group. The proposed resolution authorizes the City Manager to execute the attached Agreement of Acquisition, certificates of acceptance, and related instruments located within assessor’s parcel number 0033-042-360 (Property) to construct the necessary improvements.
DISCUSSION
The B Gale Wilson Boulevard Bus Stops Project (Project) entails constructing two bus stops with Americans with Disabilities (ADA) compliant pedestrian waiting areas at the B Gale Wilson Boulevard and Dana Drive intersection. The proposed bus stops will be located at the eastbound and westbound direction of the intersection. The westbound bus stop will serve patients near Northbay’s welcome pavilion and emergency room, and the eastbound bus stop will serve patients at the Northbay medical offices. The pedestrian waiting area for the eastbound bus stop will be constructed adjacent to the existing sidewalk within an existing PSE. To construct the ADA compliant pedestrian waiting area for the westbound bus stop, the Project must obtain a PSE on Northbay property.

The Agreement for Acquisition grants the City a 5 feet wide by 25 feet long PSE to construct the necessary ADA compliant pedestrian waiting area within the Property. Because the easement is located within a landscaped area, the City will need to remove/replace existing turf and irrigation system. In addition, the roots of two olive trees within the easement area will need to be trimmed. If the City finds that the trees need to be removed, the City will remove the trees at no expense to Northbay.

Following the execution of this Agreement for Acquisition, staff will execute a construction contract with FBD Vanguard Construction, Inc., Livermore, Ca (FBDV). Staff advertised the Project for construction in May 2020, and FBDV submitted a bid in the amount of $87,729.00 on June 2, 2020. Staff reviewed FBDV’s bid and determined that it is responsive and meets all bid requirements. FBDV is appropriately licensed to perform the work.

FINANCIAL IMPACT
The total purchase price for the Easement, to be paid by the City, is $1,300.00. Should the trees require removal, the City will compensate the property owner $2,000.00 for each removed tree. Funding for this Agreement for Acquisition is budgeted in the Capital Transit Fund (Fund 451, Division and Responsibility Code 76108).
