First Reading and Introduction of an Ordinance 2020-09 of the City Council of the City of Fairfield Adding a New Section 11.8.8 to Chapter 11, Article VII of the Fairfield City Code to Restrict Public Access to a Portion of the “Prune Yard” Parking Lot, Located at 1001 Webster Street, Fairfield, CA 94533

Waive full reading, read by title only, and introduce ordinance for first reading.

Criminal activity is of a concern in the Prune Yard where City employees generally park their personal and work vehicles.

Criminal activity that has occurred includes vehicle burglaries, vehicle tampering, littering, and subjects without purpose/business entering or remaining in the lot. The criminal activity listed above is a growing concern for City employees, and a concern to City property held in the lot. Currently there is no restriction preventing anyone from entering into or remaining in the lot.

In conferring with the City Attorney’s Office, the attached draft ordinance was created. The ordinance would restrict access to the eastern portion of the Prune Yard (1001 Webster St) or what is commonly referred to as Prune Yard 2. This lot is identified below in yellow and is bound by a fence line on the north, east and south, and a tree line and improvement separation on the west side. In working with the Solano County District Attorney’s Office, it is suggested the ordinance be progressive in severity, starting as an infraction and elevating to a misdemeanor upon the fourth offense. This process is important as it will show and indicate the offense is from a habitual offender when it reaches a misdemeanor level.

The fiscal impact of the proposed Ordinance will include the cost to purchase and install signs around the Civic Center complex to provide conspicuous notice of the ordinance and times of closure.

City Council may decline to adopt the proposed Ordinance.
