SUBJECT:Resolution 2020-131 of the City Council of the City of Fairfield Approving Plans and Specifications and Awarding a Contract to R + R Pacific Construction for the Community Spaces Initiative – Allan Witt Community Park Phase 1 Skate Park Improvements & Phase 2 Dog Park Project

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
As part of the Community Space Initiative’s five-year implementation plan, the proposed project will complete skate park improvements and construct a new dog park at the Allan Witt Community Park. This resolution approves the plans and specifications for Allan Witt Community Park Phase 1 Skate Park Improvements and Phase 2 Dog Park Project and awards a contract in the amount of $3,473,624.95 to R + R Pacific Construction of Woodland, California.
DISCUSSION
In March 2018, Council approved the conceptual master plan to renovate Allan Witt Community Park. Based on the planned improvements, full build-out of the plan requires multiple phases over multiple years to match available funding. The initial improvements, known as the Allan Witt Community Park Phase 1 Skate Park Improvements and Phase 2 Dog Park Project (Project), are prioritized to create significant changes in areas of the park where undesirable activities are occurring, and create new, positive, community oriented spaces.

The proposed Project includes access and security improvements at the skate park and the construction of a new dog park. Key components of the proposed Project include:

• Skate Park Improvements – Installation of an eight-foot tall tubular steel perimeter fence, maintenance and pedestrian gates to limit skater access and hours of operation, a new maintenance/public safety access road to provide better access and visibility to the facility, and installation of a new picnic table under the shade of an existing tree. Staff worked closely with the local Rotarians and the skating community to coordinate the proposed improvements.

• Dog Park –– The new small and large dog parks are located in the northeast corner of Allan Witt Community Park and will encompass approximately 6 acres of the overall park. Work includes the realignment of the vehicle access road through the park with a 12 ft wide multi-use trail running the length of the new roadway. The roadway realignment will allow for better eyes on the park and allow for better access to park amenities. Improvements also include repositioning existing security level lighting and closed circuit television cameras to provide adequate coverage, a parking lot directly adjacent to the dog parks, the addition of fully fenced small and large dog park play areas containing drinking fountains, shade structures, and agility and play elements for the dogs. The existing restroom facility located adjacent to the play area will be removed and repurposed at Laurel Creek Community park at a future date. The existing play area will be removed during construction in preparation for the next fully funded Phase 3 – All Accessible Play Area of the Allan Witt Master Plan Renovation.

Staff is recommending awarding the two additive alternatives for this Project. Additive Alternative No. 1 replaces the material for the multi-use path from hot-mix asphalt to concrete. Additive Alternative No. 2 replaces portions of the mulch and decomposed granite areas of the large dog park with a looped all-weather concrete pedestrian pathway.

Bids for the project were opened on June 9, 2020. Four bids were received, and the bid amounts submitted ranged in price from $3,473,624.95 to $4,710,416.10. The Engineer's Estimate is $3,447,823.00. The low bidder is R + R Pacific Construction of Woodland, California.

On June 15, 2020, the City received a bid advisory, submitted by the Foundation for Fair Contracting (FFC), against R + R Pacific Construction (FFC Case NO. 751FA). The advisory letter from FFC raised concern about the ability of R + R Pacific Construction to fulfill its obligations, with the rules and regulations governing the payment of prevailing wages, while successfully performing it duties on the Project. R+R Pacific Construction has acknowledged in their own response that they have mitigated the specific violation through payment of penalties, thus addressing the issue at hand. This explanation and evidence of resolution supports R+R Pacific Construction’s commitment to comply with the state and local law as required by the contract with the City. Staff completed the review of R + R Pacific Construction’s bid and found it to be responsive and meets all bid requirements. Staff continues to recommend awarding the Base Bid, plus Additive Alternative No. 1 and No. 2, to R + R Pacific Construction in the amount of $3,473,624.95.

FINANCIAL IMPACT
The construction authorization for this Project will be $3,820,987.45, which is the total bid amount plus a 10% contingency ($3,473,624.95 total bid + $347,362.50 contingency). Funding for the construction of this Project was approved with the Mid Cycle Budget Update for fiscal year 19/20 & 20/21 in the Parks Capital Project Fund (Fund 251, Division and Responsibility 99306) utilizing AB 1600 Parks and Quimby – Central Fairfield.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION 
A notice inviting bids was advertised twice in the Daily Republic on May 7, 2020, and May 14, 2020. In addition, staff emailed a notice of the project construction documents to 17 builder's exchanges in the State of California covering the area from Redding to San Jose and Stockton to Santa Rosa. A total of seven (7) contractors purchased bid documents.
ALTERNATIVE ACTION 
If the City Council has any questions on the project or funding, this request may be delayed so staff may provide the necessary information.
