SUBJECT:Resolution 2020-127 of the City Council of the City of Fairfield Approving the Plans and Specifications and Awarding a Contract to REM Construction for the Fairfield Sports Center Fire Rebuild Project

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
Reconstruction of the Fairfield Sports Center at Allan Witt Park is necessary to repair the extensive fire damage caused to both the men’s and women’s locker rooms, saunas and restrooms. Additionally, since the Fairfield Sports Center must be temporarily closed to complete construction, the proposed project includes the creation of additional storage space, establishing two new all-gender restrooms, and ADA upgrades to the facility.

The resolution approves the plans and specifications for the Fairfield Sports Center Fire Rebuild Project (Project) and awards a contract in the amount of $758,118 to REM Construction, Inc. of Chico, California.
DISCUSSION
In November 2017, a structure fire at the Fairfield Sports Center at Allan Witt Park caused extensive fire, smoke and heat damage to both the men’s and women’s locker rooms, saunas and restrooms. The damage forced a temporary closure to allow for an emergency cleanup and partial restoration prior to limited reoccupation.

In December 2017, City Staff filed a claim with the City’s insurance provider and sought approval to award an emergency contract in order to complete a cleanup that would consist of the removal of water, damaged building components, and smoke and fire residue. Under the advice of the City’s insurance claims adjuster, the City completed all cleanup efforts in a timely manner to prevent further unrepairable damage under the premise that permanent improvements would require assembly of plans in advance of a formal bidding process. The City was reimbursed by the insurance carrier for the cost of the cleanup effort.

The Project will complete the necessary reconstruction of the fire damaged spaces and includes a bid alternate for construction of two new ADA accessible all-gender restrooms. The final design considers current operational needs, resulting in additional ADA enhancements and the conversion of the locker room and sauna space to storage areas. The proposed layout creates a more efficient use of space to enhance guest services and better serve the needs of the community.

The bid schedule consists of a Project Base Bid contract for the reconstruction of the fire damaged areas, and an additive alternative to include the construction of additional ADA accessible all-gender restrooms in a portion of the lobby.

Bids for the project were opened on June 2, 2020. Four bids were received, and the bid amounts submitted ranged in price from $758,118 to $901,026. The bid documents established that the determination of the low bidder for the basis of bid award shall be sum of the base bid and the additive alternative (Total Bid = Base Bid + Additive Alternative).

REM Construction, Inc. of Chico, California, was the low bidder at $758,118. The engineer’s estimate was $812,789. Staff is recommending that the additive alternative be awarded (ADA accessible all-gender restroom).

Staff has reviewed the bid submitted by REM Construction, Inc. and determined that it is responsive and meets all bid requirements. REM Construction, Inc. and their subcontractors are appropriately licensed and have completed projects of similar size and complexity for other public agencies.

The City’s insurance adjuster had informed staff that after payment of the insurance deductible ($25,000), the City’s policy would cover all design and construction costs, except those associated with development of the two ADA accessible all-gender restrooms. The insurance carrier has already reimbursed the City $88,000 for design services and $395,000 towards rebuilding the fire damaged spaces. All costs associated with development and construction of the ADA accessible all-gender restrooms are funded utilizing Construction License Tax (Fund 061).

FINANCIAL IMPACT
Total authorization for the construction contract will be $909,741.60, which is the Base Bid, Additive Alternative #1, plus a 20% contingency ($758,118 ($651,403 base bid + $106,715 add alt #1) + $151,623.60 contingency). Staff is requesting a 20% contingency in lieu of the traditional 10%, because of the complexity and nature of the work. Remodel projects such as this tend to uncover issues that were not anticipated and not monetarily accounted for. Funding for this Project is budgeted in the Public Buildings Capital Project Fund (Fund 254, Division and Responsibility Code 99330).

City staff has informed the insurance claims adjuster of the bid results and intends to submit a claim for the remainder of the cost to rebuild the fire damaged space. The original estimate to rebuild the fire damaged spaces, which has already been disbursed by the City’s insurance carrier, was $395,000.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION 
A notice inviting bids was advertised twice in the Daily Republic on April 30, 2020 and May 7, 2020. In addition, staff emailed a notice of the project construction documents to 17 builder's exchanges in the State of California covering the area from Redding to San Jose and Stockton to Santa Rosa. Twelve contractors attended a mandatory pre-bid meeting.
ALTERNATIVE ACTION 
The City Council could choose not to adopt the resolution but doing so would severely limit program operations and reduced public services.
