| | | | | | | | STATEMENT OF ISSUE | The City of Fairfield has created and implemented a Complaint and Grievance Procedure to meet the requirements of the Americans with Disabilities Act of 1990 (ADA) and Section 504 of the Rehabilitation Act of 1973 for prompt and equitable resolution of complaints alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the City of Fairfield. The U.S. Department of Housing and Urban Development (HUD) requires entities that receive federal funding to implement and maintain approved grievance procedures.Therefore, City Council is asked to formally adopt the Grievance Procedure under the Americans with Disabilities Act and Section 504 as required by HUD. |

| | | | | | | | DISCUSSION | The City of Fairfield is a recipient of various federal funding sources including Community Development Block Grant funds. As such, applicants and recipients of the City's federally funded programs must have a process to initiate and file a complaint related to discrimination, harassment, and/or exclusion based on disability.
The City takes issues related to the Americans with Disabilities Act and Section 504 very seriously. Therefore, staff worked closely with HUD to create a comprehensive Grievance Procedure under the Americans with Disabilities Act and Section 504 to provide such a method that can be utilized for all federally funded City programs. This process provides clearly identifiable contacts within the City; the process for filing a compliant; a timeline for response; and an appeal process, should one be needed.
Since the creation and implementation, the procedures have been posted in visible locations such as the City's website and in each City department. In addition, the procedures now accompany all federally funded program applications to ensure residents are aware of the process should they need it.
