SUBJECT:Resolution 2020-29 of the City Council of the City of Fairfield Approving Plans and Specifications and Awarding a Contract to Bobo Construction, Inc. for the Fairfield Council Chamber Remodel Project and Updating the Fiscal Year 2019/2020 Budget

RECOMMENDED ACTION 
Adopt resolution.
STATEMENT OF ISSUE 
A renovation of the City of Fairfield Council Chamber interior and exterior spaces is required to meet current Americans with Disability Act (ADA) standards. Additionally, since the Council Chamber must be temporarily closed to complete construction, the proposed project includes deferred maintenance, safety, information technology, and audio-visual upgrades.

This resolution approves the plans and specifications for the Fairfield Council Chamber Remodel Project (Project) and awards a contract in the amount of $2,002,000.00 to Bobo Construction, Inc. of Elk Grove, California, and updates the fiscal year 2019/2020 budget.
DISCUSSION

The Fairfield Council Chamber, located at 1000 Webster Street, was completed in 1972 and designed by Robert Wayne Hawley & Associates. With its sloping windows, clean, angular brick walls, and 27-foot square skylight, the Chamber provides Fairfield’s Civic Center with timeless beauty. While the proposed project will maintain the architectural features of the existing structure, there is a need to bring the facility into ADA compliance to meet federal mandates from the Department of Housing and Urban Development Office of Fair Housing and Equal Opportunity (HUD).

The Project will complete the required ADA improvements including re-sloping the floor, replacing the dais, and replacing the fixed seating. The Project also requires a reduction of 14 fixed seats, in order to incorporate four new ADA accessible seats. To ensure the Project construction contract could be scaled to meet available funding, the bid package consisted of a base contract with four additive alternatives. In addition to the ADA improvements, the Project base contract includes new lighting, new doors, new electronic security system including cameras and door access control, new mechanical, electrical, and fire alarm work.

The following is a summary of each Additive Alternative included with the bid:

1. Modernize the heating, ventilation, and air conditioning system
2. Update the audio and visual components
3. Replace the low slope roofing membrane
4. New storefront window and door assembly between the lobby and chambers

 

Bids for the Project were opened on January 22, 2020. Six bids were received, and the bid amounts submitted ranged in price from $2,112,000.00 to $3,054,843.56. The bid documents established that the basis for determination of the low bidder on the Project would be the Base Contract plus the four Additive Alternatives. The Engineer’s Estimate is $1,835,000.00. The apparent low bidder is Bobo Construction, Inc. of Elk Grove, California, in the amount of $2,112,000.

Staff has reviewed the bid submitted by Bobo Construction, Inc. and determined the bid is responsive and meets all bid requirements. Staff recommends awarding the Base Bid and Additive Alternatives #1, #2, and #3 to Bobo Construction, Inc. for a total contract amount of $2,002,000.00. Additive Alternative #4 is not being recommended because pricing for this work was significantly higher than expected.


FINANCIAL IMPACT
The construction authorization for this Project will be $2,402,400.00, which is the Base Contract, Additive Alternate #1, #2, and #3 amounts plus a 20% contingency ($2,002,000.00 total base contract including additive alternatives #1, #2, & #3, + $400,400.00 contingency). Staff is requesting a 20% contingency in lieu of the traditional 10%, because of the complexity and nature of the work. Remodel projects such as this tend to uncover issues that were not anticipated and not monetarily accounted for.

Partial funding for the construction of the Project is accounted for in the Public Buildings Capital Project Fund, $2,000,000.00 (Fund 254, Division and Responsibility 99325). Additional funds from Special Program Funds ($143,000.00, Fund 041) utilizing Public, Educational & Governmental (PEG) Access Channel Fees collected from the City’s Cable Franchise Agreement are to be transferred to the Public Buildings Capital Project Fund, (Fund 254, Division and Responsibility Code 99325) to cover the cost of Additive Alternative #2. Funds from Construction License Tax ($259,400.00, Fund 061) are to be transferred to the Public Buildings Capital Project Fund, (Fund 254, Division and Responsibility Code 99325) to cover the cost of this project. Finance has confirmed that adequate reserves in Fund 061 exist and that no projects on the 10-year project horizon will be jeopardized by this additional expenditure.

PUBLIC CONTACT/ADVISORY BODY RECOMMENDATION 
A notice inviting bids for the project was advertised twice in the Daily Republic on December 13, 2019, and December 20, 2019. In addition, staff emailed a notice of the project construction documents to 17 builder's exchanges in the State of California covering the area from Redding to San Jose and Stockton to Santa Rosa. A total of four contractors purchased bid documents for the project from the City.
ALTERNATIVE ACTION 
If the City Council has any questions on the project or funding, this request may be delayed so staff may provide the necessary information. However, delaying this award will have significant negative impacts to the project’s construction schedule. Staff has arranged to temporarily house the regularly scheduled meetings of the City Council in the Fairfield-Suisun Unified School District Board Room from March 2020 to December 2020. Any delay may require that staff secure an additional meeting space, if the project is not substantially complete by the end of December 2020; or the City may be forced to pay acceleration fees to the contractor.
